1 Kinnettas Cottages            Holiday Let Terms and Conditions 

  1. Period of Hire. Letting commences at 4pm on the day of arrival and terminates at 10am on the day of departure. This is to allow time for the property to be prepared for you. Lets are on a weekly basis (Saturday to Saturday) and the maximum period of let is 3 weeks. The house is let for holiday purposes only and only to the persons named on the booking form. Short term lets of 3 or 4 days may be possible subject to availability. 3 nights start on Friday, 4 nights start on Monday.
  2. Availability. To check availability or make a provisional booking please contact the Owner on 0131 202 6363 or by email to Mark.Harrison@e-litigate.com
  3. Booking & Payment. A firm booking is accepted, and a contract formed, following confirmation of availability, receipt of a completed booking form, acceptance of this by the Owner, and payment of a deposit of 30% of the rental. At this stage the Hirer becomes liable for the full rental for the week(s) booked. The balance shall be payable 6 weeks before the commencement of the letting period. Non-payment of any balance due by this time will mean the Owner will hold the contract as terminated, allowing him to treat the cottage as being available for re-letting.For bookings made less than 6 weeks in advance, full payment is required at time of booking.Acceptable methods of payment are cheques drawn on a UK bank account, GBP travellers cheques, an International Money Order in GBP, and direct bank transfer.  Where bank fees are incurred by the Owner for any non-standard payment method, or for currency conversion from Euros to Sterling, then these charges shall be met by the Hirer in addition to the rental.
  4. Cancellations. Any cancellation will require to be confirmed in writing. Should a cancellation be made by the client, the Owner shall seek to re-let the property for the full original period of hire. Where deposit only paid - If we are successful in re-letting the property for the full original period of hire, a full refund of the deposit will be made, less an administrative charge of £40 per week booked to cover handling and re-advertising. If we succeed in re-letting for a period less than the original period of hire, we will refund a proportionate sum to the client, less an administrative charge of £40 per week booked to cover handling and re-advertising. If we are unsuccessful in re-letting for any of the original period of hire, the deposit will be forfeited by the client. Cancellations within 6 weeks of hire - If cancellation occurs less than 6 weeks prior to hire and we are successful in re-letting the property for the full original period of hire, a full refund of the rental will be made, less an administrative charge of £40 per week booked to cover handling and re-advertising.  If we are only able to re-let the property for a proportion of original period of hire, or not at all, then a fee of 50% of the rental will be forfeited by the client. If the cottage cannot be made available for the period booked due to events beyond the Owner’s control and the Owner is forced to cancel the booking, the whole of the hire charge will be refunded and the Hirer will have no further claim against the Owner. To cover these eventualities, you may wish to arrange your own holiday cancellation and curtailment insurance.
  5. Services. Use of electricity and logs for the wood-burning stove are included in the weekly tariffs quoted. All linen and towels are provided.
  6. Number of Persons using the property. The number of persons occupying the property shall not exceed the maximum number of six.  Subletting is strictly prohibited.
  7. Complaints. It is our wish that you have a relaxing and enjoyable holiday. In the unlikely event that you have any cause for complaint about the cottage during the period of letting, then it is essential that you contact the owner immediately to allow us an opportunity to rectify any problem.
  8. Breakage or Damage. The Hirer is responsible for the condition of the property and its entire contents during the hire period, fair wear and tear excepted. The Hirer will make good any damage or loss.  The person held to be responsible for the hiring party will be the person who signed the booking form. Replacement items will be charged at cost.
  9. Care of Property. The property is cleaned thoroughly between each let. However, as only a limited period of time is available for this, it is a condition of your let that you leave the property and its contents clean and tidy.
  10. Pets. Regretfully we are unable to accommodate pets.
  11. Smoking. Regretfully smoking is not allowed within the cottage.
  12. Right of Entry. We reserve the right of entry to the property at all reasonable times for the purposes of inspection or to carry out necessary repairs or maintenance.
  13. Injury, Loss or Damage. The use of the cottage and its equipment is entirely at the Hirer's risk and no responsibility can be accepted by the Owner for injury to the Hirer or a member of his or her party, nor for injury, loss or damage to their belongings, including motor vehicles.
  14. Liability. We shall have no liability for any death, personal injury, damage or loss of personal property unless this results from our own negligence.
  15. Contract. The Contract of Hire is between the Hirer and Mr Mark Harrison, the Owner of 1 Kinnettas Cottages. The contract effected between the Hirer and the Owner is in terms of Schedule 4 Section 8 of the Housing (Scotland) Act 1988 and confers on the Hirer the right to occupy the property for the period agreed for holiday purposes only. The Contract will be subject to Scottish Law. In case of dispute, the parties agree to submit to the exclusive jurisdiction of the Scottish courts.
